Race Discrimination

Race Discrimination was one of the primary reasons the Civil Rights Act of 1964 was enacted. Unfortunately, 50 years after the passage of that monumental legislation, race discrimination in society and the workplace has not been eliminated.

Race Discrimination in Employment

Employment Discrimination based on race involves treating an applicant or employee differently because of their race or because of personal characteristics associated with race such as hair texture, skin color, or facial features.

Race discrimination can also involve treating someone differently because they are married to or associated with a person of a certain race or because of a person’s connection with race-based organizations or groups.

Race Discrimination in employment is illegal. Federal and New York State law prohibit discrimination in all aspects of employment including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment.

Race Discrimination & Harassment

Federal and New York State law prohibit race-based harassment. Harassment can take the form of racial slurs, jokes, and offensive or derogatory remarks about a person’s race or color. Harassment based on race can also exist where offensive symbols or pictures are displayed in the workplace.

When harassment occurs, it is usually by a co-worker or supervisor. However, the law also protects employees from harassment by someone who is not an employee of the employer, such as a client, customer or supplier.

Racially Discriminatory Employment Policies & Practices

A seemingly lawful employment policy or practice can be illegal if it has a negative impact on employees or applicants of a particular race. For example, an employer’s grooming policy or testing procedures may be unlawful if they have a negative impact on the employment of people of a particular race.
