National Origin Discrimination
Both federal and New York Law prohibit employment discrimination based on national origin in hiring, firing, pay, assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment.
These prohibitions against National Origin discrimination cover a wide variety of workplace biases including those against a group or individual’s:
- country of origin
- ethnicity
- language or accent
- culture or customs
- ancestry
- physical traits
While claims of national origin discrimination are usually brought by an individual of foreign ancestry, Americans can also assert claims of national origin discrimination against foreign companies operating in the United States.
Discrimination Based Upon Perceived National Origin
National Origin discrimination can be found when an employer’s conduct is based upon a perception or belief about an individual’s national origin. For example, discrimination against someone perceived as being Arab based on his speech, surname, mannerisms, or appearance, regardless of whether he is, in fact, of Arab ethnicity.
National Origin Association Discrimination
National Origin discrimination can also involve treating someone differently because they are married to or associated with a person of a certain national origin or because of a person’s connection with organizations or groups associated with a particular national origin, ethnicity or culture.
Harassment Based on National Origin
It is unlawful to harass an individual because of their national origin. Harassment can include, for example, offensive or derogatory remarks about a person’s national origin, culture, ancestry, language, accent or ethnicity.
English-Only Policies
A workplace rule which requires employees to speak only English is unlawful unless it is necessary to ensure the safe or efficient operation of the employer’s business and is put in place for nondiscriminatory reasons.
