On January 1, 2024, New York’s minimum wage will increase to $16/hour in New York City, Westchester, and Long Island, and $15/hour for the rest of the state. Looking ahead, the minimum wage will increase by $0.50 in 2025 and 2026. In 2027, it will increase annually at a rate determined by the Consumer Price Index.
This past Fall, the New York State Department of Labor also published proposed regulations increasing the salary threshold for exempt executive and administrative employees. On December 27, the NYSDOL approved these regulations and announced they will become effective January 1, 2024, giving employers little time to implement the necessary changes. So in order to avoid paying your exempt salaried employees for overtime hours, make sure they are paid at least the minimum salary thresholds:
For New York City, Westchester, and Long Island:
- 2024 – $1,200.00/week ($62,400.00 per year)
- 2025 – $1,237.50/week ($64,350.00 per year)
- 2026 – $1,275.00/week ($66,300.00 per year)
For the rest of New York:
- 2024 – $1,124.20/week ($58,458.40 per year)
- 2025 – $1,161.65/week ($60,405.80 per year)
- 2026 – $1,199.10/week ($62,353.20 per year)
In addition to meeting the salary threshold, employees must also satisfy a duties test applicable to executive and administrative employees (professional employees have no New York salary threshold but a duties test does apply) in order to be properly categorized as exempt from overtime requirements.
