Sexual Orientation Discrimination

Discrimination in employment based upon an individual’s sexual orientation in unlawful under the New York State Human Rights Law.

Sexual Orientation discrimination includes decisions regarding hiring, firing, pay, assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment that is based upon an individual’s heterosexuality, homosexuality, bisexuality or asexuality, whether actual or perceived. If your employer is treating you differently because of your sexual orientation or their perception of your sexual orientation, their conduct is unlawful.

New York City and Suffolk County Law also prohibit discrimination in employment based upon gender identity which protects individuals who are transgendered, transsexual and intersexual and includes self-image, appearance, behavior or expression, whether or not they differ from that traditionally associated with the legal sex assigned to that person at birth.
